Robert F. Kennedy Jr. not eligible for Biden and Trump presidential debate

Independent presidential candidate Robert F. Kennedy has faced a setback in his campaign as he failed to qualify for the upcoming presidential debate with President Biden and former President Donald Trump. The debate, scheduled to be hosted by CNN in Atlanta on June 27, will not include Kennedy due to his inability to meet the debate requirements set forth by the network.

CNN’s criteria for participation in the debate mandate that a candidate must appear on a sufficient number of state ballots to be eligible to win 270 electoral votes, the number required to secure the presidency. Kennedy, who is on the ballot in five states including Utah, Michigan, Delaware, Oklahoma, and Tennessee, has a total of 42 electoral votes to his name. Additionally, he will be on the ballot in California as the nominee of the American Independent Party and in Hawaii under his We the People ticket, bringing his potential electoral votes to 100. However, despite his efforts to secure ballot access in multiple states, some of his applications are still under review by state election offices.

In addition to ballot access, candidates were also required to meet a polling threshold of 15% in four major national polls by June 20. Unfortunately for Kennedy, he fell short of this requirement, only qualifying in three national polls. This failure to meet the polling threshold further contributed to his exclusion from the upcoming debate.

Kennedy expressed his disappointment and frustration with being excluded from the debate stage, attributing it to the actions of Presidents Biden and Trump. In a statement, he accused CNN of illegally agreeing to their demands and criticized the decision to exclude him as undemocratic, un-American, and cowardly. Kennedy’s campaign had previously filed a complaint with the Federal Election Commission (FEC), alleging that CNN, Biden, Trump, and their campaigns violated federal election law by approaching the debate criteria differently for Kennedy compared to the presumptive nominees of the major parties.

The complaint filed by Kennedy’s campaign claimed that CNN’s handling of the debate criteria was biased and unfair, ultimately constituting an illegal campaign contribution to both Biden and Trump. The debate, scheduled to take place before the Democratic and Republican conventions formalize their nominees, was seen as a strategic move to benefit the two major party candidates at the expense of an independent contender like Kennedy. Despite the campaign’s efforts to challenge the legality of the debate, Kennedy stated that he could not file a lawsuit until the FEC complaint was dismissed.

The FEC’s response to Kennedy’s complaint remains pending, with no decision reached as of yet. While the campaign asserted that the FEC acknowledged the potential merit of their complaint, the commission declined to comment on the ongoing investigation. Kennedy’s team is hopeful that the FEC will ultimately rule in their favor and address the alleged violations of federal election law by CNN, Biden, and Trump.

As Kennedy navigates the challenges of his independent campaign, facing obstacles in gaining access to debates and reaching the polling thresholds required for visibility, his team remains committed to advocating for his inclusion in the electoral process.
