Pentagon Investigates Sen. Mark Kelly for Urging Defiance of Illegal Orders in Video

In a recent development from Washington, the Pentagon has announced that it is undertaking a comprehensive review of misconduct allegations against Senator Mark Kelly of Arizona. Kelly, a Democrat and former U.S. Navy captain, may potentially be recalled to active duty to face court-martial proceedings, depending on the outcomes of this review. This situation arises following the release of a controversial video last week in which Kelly, along with a group of lawmakers, urged military members and intelligence community personnel to refuse any illegal orders they might receive.

The video in question, which has sparked a heated debate across political and military spheres, featured Kelly alongside five other Democratic lawmakers – all of whom have backgrounds in national security or military service. These include Senator Elissa Slotkin of Michigan, and Representatives Jason Crow of Colorado, Chris Deluzio and Chrissy Houlahan of Pennsylvania, and Maggie Goodlander of New Hampshire. In the video, the group collectively stressed the importance of adhering to constitutional values and protecting it against perceived threats, even going as far as encouraging the defiance of orders deemed illegal.

This act, however, did not sit well with President Trump, who launched a severe criticism against the lawmakers, labeling their actions as “seditious behavior”. Trump’s outburst was not just limited to verbal denunciations; he escalated the matter significantly with social media posts suggesting extreme measures, including a controversial remark where he insinuated that George Washington would have endorsed capital punishment for such acts. Though he later clarified that he was not directly threatening death, he maintained that the lawmakers were in “serious trouble.”

Amidst this political uproar, Defense Secretary Pete Hegseth took to social media to add to the controversy by coining the term “Seditious Six” in reference to the group of Democrats involved in the video’s production. He pointed out that while the Pentagon doesn’t have jurisdiction over five of the six lawmakers, Mark Kelly’s case stands as an exception.

The Pentagon also highlighted that federal law explicitly forbids actions intended to disrupt the loyalty, morale, discipline, or order of the armed forces. They cited a specific code which prohibits any activity designed to cause insubordination, disloyalty, mutiny, or refusal of duty within the military’s ranks. Given Kelly’s previous service as a Navy captain and his direct appeal to service members in the video while referencing his military rank, the Pentagon is scrutinizing whether his actions merit severe reprimands, including possible court-martial.

Reacting to these developments, Senator Kelly expressed his concerns and dismay, stating that he learned about the ongoing investigation against him through social media. He vehemently opposed the implications of the investigation, suggesting it was a tactic aimed at intimidating him and his colleagues from fulfilling their legislative duties and holding the administration accountable. Kelly reiterated his commitment to the nation and the Constitution, affirming that no amount of bullying would deter him from his responsibilities.

In defense of their actions, Kelly pointed out during an appearance on “Face the Nation with Margaret Brennan” that the message they intended to communicate through the video was based on lawful grounds – it reaffirmed that military personnel are bound to reject illegal orders as dictated by the law itself.
