The United Nations High Commissioner for Human Rights, Volker Türk, recently released a report detailing the harrowing reality faced by both the people of Israel and Gaza since October 7, 2023. The report emphasizes the urgent need for Israel to fully comply with its obligations under international law and the rules of war.
Türk stressed the importance of holding Israel accountable for the serious violations of international law through credible and impartial judicial bodies. He emphasized the necessity of collecting and preserving all relevant information and evidence in the meantime. The Commissioner highlighted the critical nature of this situation, especially considering Israel’s ongoing operations in northern Gaza and its impact on the activities of the UN agency for Palestine refugees, UNRWA.
The report delves into the violations that occurred during the six-month period from November 2023 to April 2024, focusing on the killing of civilians and breaches of international law that could potentially amount to war crimes. If these violations were part of a widespread or systematic attack targeting a civilian population, following a State or organizational policy, they may constitute crimes against humanity. Additionally, if these violations were carried out with the intent to destroy, in whole or in part, a national, ethnic, racial, or religious group, they may be considered genocide.
The International Court of Justice (ICJ) has underscored Israel’s international obligations to prevent, protect against, and punish acts of genocide and associated prohibited conduct. The report emphasizes the gravity of the situation and the need for accountability.
Palestinian armed groups have also been implicated in committing serious violations of international law, contributing to harm to civilians. Hamas and other militant groups were accused of attacks against Israeli and foreign civilians, the killing and mistreatment of civilians, sexual violence, destruction of civilian objects, and taking hostages. These acts could potentially constitute war crimes and crimes against humanity. The report condemned the celebration of these attacks and violations by Hamas and other armed groups, deeming it unacceptable.
Türk reminded States of their obligations to prevent atrocity crimes and urged them to support accountability mechanisms, including the International Criminal Court (ICC) in addressing the current conflict. The report also highlighted statements from Israeli officials suggesting that the conflict’s end was contingent upon the destruction of Gaza, a concerning stance that further exacerbates the situation.
The report sheds light on the dire humanitarian crisis unfolding in Israel and Gaza, calling for immediate action to address the violations of international law and protect the civilian population. The importance of accountability, justice, and respect for human rights cannot be overstated in such a volatile and tragic situation. It is imperative for all parties involved to uphold their obligations under international law and work towards a peaceful resolution to the conflict.
